The banking & finance department of The Collins Law Firm provides a full range of transactional and litigation services to our clients. The Firm’s representation in loan origination includes drafting, negotiating, and closing transactions secured by all types of real estate, personal or intangible property, and asset-based lending. In loan origination, the Firm counsels and assists with the origination and servicing of construction and draw loans, revolving credit facilities, and transactions involving out-of-state collateral. The Firm also represents financial institutions and private equity groups in complex or sophisticated credit facilities, including subordinated lending, mezzanine financing, and syndicated or participant loans.
In addition, we are seasoned litigators and provide strategies and solutions in troubled assets and default situations. This includes complex loan workouts and forbearance agreements. With respect to defaults, the Firm has significant experience in collateral foreclosures, resolving liens and litigating lien priority, and complex creditor-rights litigation.
The Firm further assist financial institutions and private lenders in post-recovery of assets, including REO management and collateral sales, auctions, and leases.
To complete our full-service representation, we provide compliance advice, corporate governance assistance, and lender-liability avoidance strategies to our financial institution clients. The Firm’s attorneys have significant experience in lender liability and D&O defense in the community banking industry, including representation during appeals.
